TRAFFIC CRIMES/CITATIONS
Living in Colorado, or just about any part of the western United States, and getting to and from work, going to the grocery store, or even taking your children to school or to appointments requires a person to have a driver’s license. Getting a traffic charge can put your driving privilege at risk. Having an experienced defense attorney to defend you against a traffic charge can keep you on the road.

SPEEDING / CARELESS / RECKLESS
Most moving violations under Colorado’s Title 42 or the Uniform Traffic Code can come with a number of points which will be assessed against you if you are convicted of the specific charge. In Colorado, a person has a finite number of points which may be assessed against them at any given time, before their license is revoked. For those 21 years of age and older, you have 12 points to work with. For those 18-21 years of age, you have 9 points to work with. For those under 18 years of age, you have only six points to work with.
Speeding/Careless/Reckless Charges:
Speeding (C.R.S. 42-4-1101)
1-4 Miles Per Hour Over = 0 points
5-9 Miles Per Hour Over = 1 point
10-19 Miles Per Hour Over = 4 points
20-39 Miles Per Hour Over = 6 points
40 Miles Per Hour Over = 12 points
Careless Driving (C.R.S. 42-4-1402) = 4 Points
Reckless Driving (C.R.S. 42-4-140) = 8 Points
Even the most careful driver can occasionally speed, and with all of the traffic on the road these days it is even harder to avoid having an accident. For those who have been caught driving over the posted limit, or even for those who find themselves in a fender-bender or accident, a good defense attorney is very important to have on your side. If you do get into an accident, not only is your license at stake, but a number of other consequences can put your driving privileges and even your livelihood at risk if you are found guilty of speeding, or even worse, a careless or reckless driving charge.
These charges can have a huge impact on the cost of your insurance each month, and if there were injuries involved in any accident you have been in, you may be liable for the damages you can see, and even the damages you cannot see. Make sure you have a confident and capable criminal defense attorney by your side as you defend against any traffic charge against you.
DUI/DWAI
Driving Under the Influence (DUI) or Driving While Ability Impaired (DWAI) are very serious charges (C.R.S. 42-4-1301), which can come with very long lasting and severe consequences. If you are charged with a DUI/DWAI you may face jail time, loss of insurance or a very large rate increase, job loss, and the sanctions from the court can include expensive treatment, classes, and public service as well as additional time on probation. For a second or subsequent DUI, you are likely to be sentenced to mandatory jail time.
