What IS THIRD DEGREE BURGLARY?

  • Third Degree Burglary is when a person breaks into any place where either money, drugs, or any other thing of value is kept, where the person has the intent to commit a crime.

  • Third Degree Burglary is a Class 2 Misdemeanor, unless the intent is to take a controlled substance.

    • A Class 2 Misdemeanor can come with a penalty of up to 120 days in jail, and a fine of up to $750.

  • If Third Degree Burglary is charged as a Class 1 Misdemeanor, the penalty can include up to 364 days in jail and a fine of up to a $1,000.

C.R.S. 18-4-204 - THIRD Degree BURGLARY

(1) A person commits third degree burglary if with intent to commit a crime he enters or breaks into any vault, safe, cash register, coin vending machine, product dispenser, money depository, safety deposit box, coin telephone, coin box, or other apparatus or equipment whether or not coin operated.

(2) Third degree burglary is a class 2 misdemeanor, but it is a class 1 misdemeanor if it is a burglary, the objective of which is the theft of a controlled substance, as defined in section 18-18-102 (5), lawfully kept in or upon the property burglarized.
