What IS Internet Sexual Exploitation of a Child?

  • Internet Sexual Exploitation of a Child is when a person knowingly lures, invites, or entices through internet communications or by telephone, texts, or other instant messages any other person the actor knows or believes to be under 15 years of age, and which is at least four years younger than the actor to:

    • Expose themselves or to touch their own intimate parts while communicating with the actor through internet communications, or by telephone, texts, or other instant messages; or

    • Causes the victim to observe the actor’s intimate parts through internet communications, or by telephone, texts, or other instant messages.

  • Intimate parts include breasts, butt, or genitals (penis or vagina).

  • A conviction for Internet Sexual Exploitation of a Child is a conviction that can have an indeterminant sentence.

    • This means the sentence will not specify a mandatory release date, and the sentence can last the rest of a person's life.

  • Internet Sexual Exploitation of a Child is a Class 4 Felony, which carries a penalty of up to 8 -16 years to life in the Department of Corrections, and a fine of up to $500,000.

C.R.S. 18-3-405.4 - Sexual Exploitation of a Child

(1) An actor commits internet sexual exploitation of a child if the actor knowingly importunes, invites, or entices through communication via a computer network or system, telephone network, or data network or by a text message or instant message, a person whom the actor knows or believes to be under fifteen years of age and at least four years younger than the actor, to:

(a) Expose or touch the person’s own or another person’s intimate parts while communicating with the actor via a computer network or system, telephone network, or data network or by a text message or instant message; or

(b) Observe the actor’s intimate parts via a computer network or system, telephone network, or data network or by a text message or instant message.

(3) Internet sexual exploitation of a child is a class 4 felony.
