What IS THE POSSESSION OF BURGLARY TOOLS?
Possession of Burglary Tools is when a person is found in possession of any tool or combination of tools, instruments, explosives, or other article which is commonly used to break into or facilitate the commission of the crime of breaking into any premises, and that person intends on using the tools to commit the offense.
Possession of Burglary Tools is a Class 2 Misdemeanor, unless the intent is to break into a residence (home) for a forcible taking, in which the charge will be a Class 5 Felony.
A Class 2 Misdemeanor can come with a penalty of up to 120 days in jail, and a fine of up to $750.
If Possession of Burglary Tools is charged as a Class 5 Felony, the penalty can include up to 3 years in the Department of Corrections and a fine of up to a $100,000.
C.R.S. 18-4-205 - POSSESSION OF BURGLARY TOOLS
(1) A person commits possession of burglary tools if he possesses any explosive, tool, instrument, or other article adapted, designed, or commonly used for committing or facilitating the commission of an offense involving forcible entry into premises or theft by a physical taking, and intends to use the thing possessed, or knows that some person intends to use the thing possessed, in the commission of such an offense.
(2) Possession of burglary tools is a class 2 misdemeanor, but it is a class 5 felony if the burglary tools were knowingly possessed to facilitate a forcible entry into a residence for the purpose of a physical taking.
