What IS THIRD Degree Criminal Trespass?

  • Third Degree Criminal Trespass is when a person unlawfully goes on to or remains on another person’s property.

  • This is the most typical trespass charge, and is usually charged when a person is told to leave a property by the owner and simply does not leave.

  • Third Degree Criminal Trespass of another person’s property is a petty Offense, which usually means the person will be fined, but in some cases could be held in jail for up to 10 days.

  • Third Degree Criminal Trespass can be charged as a Class 5 Felony, if the person enters on to agricultural land with the intent to commit a felony on the property, which carries a penalty of up to 3 years in the Department of Corrections, and a fine of up to $100,000.

C.R.S. 18-4-504 - THIRD Degree Criminal Trespass

(1) A person commits the crime of third degree criminal trespass if such person unlawfully enters or remains in or upon premises of another.

(2) Third degree criminal trespass is a petty offense, but:

(b) It is a class 5 felony if the person trespasses on premises classified as agricultural land with the intent to commit a felony thereon; except that it is a class 6 felony if the agricultural land did not have a fence securing the perimeter.
