What IS SECOND Degree Criminal Trespass?

  • Second Degree Criminal Trespass is when a person unlawfully goes into or remains in another person’s property which is either locked or closed in such a way to keep others out, i.e., a fenced in area or door with a lock.

  • Second Degree Criminal Trespass can also be charged when a person enters or remains unlawfully in the common areas of a hotel, motel, condominium. apartment building, or a motor vehicle belonging to another person.

  • Second Degree Criminal Trespass of another person’s property, the common area of a hotel, motel, condominium, or apartment building is a Class 5 Felony, which carries a penalty of up to 3 years in the Department of Corrections, and a fine of up to $100,000.

  • Second Degree Criminal Trespass of another person’s vehicle is a Class 2 Misdemeanor, which carries a penalty of up to 120 days in jail, and a fine of up to $750.

C.R.S. 18-4-503 - SECOND Degree Criminal Trespass

(1) A person commits the crime of second degree criminal trespass if such person:

(a) Unlawfully enters or remains in or upon the premises of another which are enclosed in a manner designed to exclude intruders or are fenced; or

(b) Knowingly and unlawfully enters or remains in or upon the common areas of a hotel, motel, condominium, or apartment building; or

(c) Knowingly and unlawfully enters or remains in a motor vehicle of another.

(2)

(a) Second degree criminal trespass in violation of subsection (1)(a) or (1)(b) of this section is a petty offense, but it is a class 5 felony if the person trespasses on premises so classified as agricultural land with the intent to commit a felony thereon.

(b) Second degree criminal trespass in violation of subsection (1)(c) of this section is a class 2 misdemeanor.
