What IS FIRst Degree Criminal Trespass?
First Degree Criminal Trespass is when a person knowingly and unlawfully goes into or remains in another person’s home without permission, or when a person goes into any motor vehicle of another with the intent to commit a crime inside the vehicle.
First Degree Criminal Trespass of another person’s home is a Class 6 Felony, which carries a penalty of up to 18 months in the Department of Corrections, and a fine of up to $100,000.
First Degree Criminal Trespass of another person’s vehicle is a Class 1 Misdemeanor, which carries a penalty of up to 364 days in jail, and a fine of up to $1,000.
C.R.S. 18-4-502 - FIRst Degree Criminal Trespass
(1) A person commits the crime of first degree criminal trespass if such person:
(a) Knowingly and unlawfully enters or remains in a dwelling of another; or
(b) Enters any motor vehicle with intent to commit a crime therein.
(2)
(a) First degree criminal trespass committed pursuant to subsection (1)(a) of this section is a class 1 misdemeanor, but it is a class 6 felony if the dwelling is inhabited or occupied.
(b) First degree criminal trespass committed pursuant to subsection (1)(b) of this section is a class 1 misdemeanor.
